CATS Suit Now Pending in Court of Appeal

A suit challenging the constitutionality of the CATS tax is now pending in the 1st Circuit Court of Appeal, and a decision is expected any day.  Milton Graugnard challenged the 10.6 mill in the City of Baton Rouge in Graugnard v. CATS.  The basis of the suit is violation of equal protection because people outside the City of Baton Rouge receive bus service, while only people in the city pay the tax.  The Louisiana Supreme Court ruled against a similar tax in Arkansas & Louisiana Railroad v. Goslin.
The Court of Appeal will rule on whether the suit was filed timely.  District Judge Todd Hernandez ruled that it was.
